Kim Quoted on CIT Order for CBP-Issued Refunds

Partner James Kim was quoted on the US Court of International Trade’s (CIT) order directing US Customs and Border Protection (CBP) to begin processing refunds on US import tariffs recently found unlawfully instituted under the International Emergency Economic Powers Act (IEEPA).

James said that the CIT order means that CBP must issue refunds to importers who paid IEEPA tariffs on entries that have not been finalized via liquidation.

“This is the most significant development on IEEPA refunds since the Supreme Court ruling itself,” he said.

However, James added that despite CIT’s ruling, the federal government could appeal the decision, which could further delay any potential action by CBP.

James said that companies should continue to monitor liquidation dates and deadlines to submit protests and register to qualify for electronic refunds via CBP’s Automated Commercial Environment.

“When refunds do start flowing, importers set up for ACH will receive their money faster and with less friction,” he said.
